SAN ANTONIO – A burglar is dead after being shot by a mother who was home with her three children on Thursday evening, April 28th.
FOX 29 San Antonio reported that a burglar broke into the woman’s home just before 10 p.m. Thursday off Kashmuir Place and Kellis Avenue.
The thug broke into the back door, letting himself into the laundry room. The noise had alerted the resident, and by the time he tried to break into the main door leading into the home, she was ready for him.
The woman shot the man twice in the chest.
“The suspect was taken to the hospital, but later died from his injuries,” FOX 29 reported. “There were three children inside the home at the time of the shooting, but no other injuries were reported.”
The man was later identified as 41-year-old Roman Rodriguez. Police late reported that when they arrived at the home, Rodriguez was sitting in a chair in the woman’s backyard, bleeding from his gunshot wounds.
Rodriguez died en route to the hospital.
According to the report, the woman will not be facing any charges due to the so-called Castle Doctrine, which is found in Texas Penal Code.
Texas’ Castle Doctrine justifies the use of deadly force against another person if the latter “unlawfully and with force entered, or was attempting to enter unlawfully and with force, the actor’s occupied habitation, vehicle, or place of business or employment.”
Not Everybody Finds Stories Like This As Heartwarming As We Do
As recently as November 2020, Texas’s Castle Doctrine was targeted for modification by Democrat State Representative Terry Meza (D-Irving).
Meza introduced House Bill 196 which would have “would require a homeowner to exhaust the potential of safely retreating into their habitation before using deadly force in defense of themselves or their property,” according to a thread on Twitter written by her on November 19, 2020.
“I filed this bill because the castle doctrine as it currently exists emboldens people to take justice into their own hands,” Meza continued in the thread.
“While theft is obviously wrong, we have laws to address that. I don’t believe that stealing someone’s lawn ornament should be an offense punishable by death.”
That bill, if passed into law, would have required this mother to retreat from the advancing thug — perhaps even leaving her children in harm’s way.
The bill died in committee in 2021.
OUR TAKE
Hats off to the mother who used her God-given gun rights to protect herself and her children from this criminal! She taught this thug a lesson in property rights and self-defense which cost him his life.
Lawmakers such as Rep. Meza spend their time in office chipping away at the Second Amendment, while ignoring the law-abiding citizen who would be victimized if their bills made it into law.
How different would this story have turned out if Rep. Meza’s bill had been enacted into law?
