Montana Governor Greg Gianforte has signed House Bill 809, preventing local municipalities from enacting, enforcing, or supporting Red Flag Gun Confiscation Orders.
Red Flag laws are the biggest tool gun control advocates are using to go after gun owners. The laws don’t require a criminal charge, trial, or conviction.
Many blue states, and even some red states, have implemented Red Flag laws, while Democrats and some Republicans continue to push a national Red Flag law.
HB 809 states in part,
enact, adopt, or implement a resolution, ordinance, rule, regulation, or policy that would have the effect of enforcing an extreme risk protection order against a resident of the state; or
(b) accept a grant or other source of funding for the purpose of aiding in the adoption, implementation, or enforcement of an extreme risk protection order.
(3) A local government that violates this section is subject to a civil penalty of up to $10,000, payable to the state general fund. Each instance of enforcement or attempted enforcement constitutes a separate offense.”
Montana is among the first states to enact a localized Red Flag law ban.
